Please read this agreement carefully. The access to and use of this electronic ordering platform implies your explicit and unreserved acceptance of all these terms and conditions, with said platform having the same validity and effectiveness as any written and signed contract.
Please read these terms and conditions carefully each time you access and use the electronic ordering platform.
Compliance with these terms and conditions shall be required from the Fluchos customer who accesses the electronic platform and places an order using the previously provided username and password. If you do not agree with these terms and conditions, please do not access or use the electronic ordering platform .
These terms and conditions are designed to regulate the conditions of entering, using, purchasing and ordering with regard to the electronic platform accessible from the website www.fluchos.com (hereinafter, the website) or from any other Internet addresses which may link thereto.
The website and the electronic platform are owned by Fluchos S.L., a company engaged in the manufacture and distribution of footwear, with Tax Code B26011627 and registered address at Calle Lavero 5, 26580 - Arnedo (La Rioja, Spain), duly listed in the Trade Register of La Rioja, Volume 480, Section 8, Folio 114, Sheet LO2181. SPECIFIC TERMS AND CONDITIONS OF THE ELECTRONIC ORDERING PLATFORM
Orders via the electronic platform may be placed on the Internet, via the website or by telephone.
The customer service hours of the Fluchos Exclusive Club online store are from 8.30 am to 1.00 pm from Monday to Friday (not including public holidays).
Delivery terms and conditions
It is not necessary to place a minimum order of items.
Orders are processed until 12.00 noon. Orders processed after that time shall be dispatched the following day. Once the order has been processed, the delivery time is 24/48 hours, if it was placed on a working day (except for deliveries to the Canary Islands, Ceuta and Melilla, and orders for laces), for Spain (mainland and Balearic Islands) and Portugal (mainland). The delivery time for orders to Europe (Andorra, Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Romania, Sweden, Switzerland) will be 3/4 days via Standard Delivery and 48 hours via Express Delivery. On Saturdays, Sundays and public holidays, there is no collection or delivery service, which should be taken into account when calculating delivery dates.
If a specific item is not in stock, Fluchos shall contact you to give a new delivery date.
Orders shall be delivered to the address you provided. Fluchos assumes no liability if the delivery cannot be made as a result of an inaccurate or incomplete address or due to your absence. Notwithstanding, Fluchos shall take the measures required of a diligent retailer to ensure that the delivery can be made as soon as possible, both to the satisfaction of the sender and of the recipient.Delivery costs shall be borne by Fluchos for orders shipped to Spain (mainland and Balearic Islands), Portugal (mainland) and Europe with the Standard Delivery option. Deliveries are not made to Madeira or the Azores. Delivery costs for orders to the Canary Islands, Ceuta or Melilla shall be borne by the customer.
The prices shown are the Recommended Retail Prices (RRP) and are only valid for Spain (mainland and Balearic Islands), Portugal (mainland) and Europe. They are indicated in euros and include applicable taxes. Fluchos reserves the right to modify prices according to market fluctuations. The prices and conditions shown are valid at any time and only when the browsing session is open.
You may choose one of the following payment methods for orders placed via the electronic platform:
- Cash on delivery (does not apply to the Canary Islands, Ceuta, Melilla and Europe
- Credit car
Complaints and grievances
Any defect or damage which you may notice in the item(s) received shall be made known to Fluchos immediately, or within a period of fifteen days from receipt of the order, by calling the customer service hotline on +34 941 384839 or completing the contact form on the website.
Returns shall not be admitted later than thirty days after delivery of the order to the customer. They shall be accepted as long as the shoes have not been worn. The cost of said returns shall be borne by Fluchos (except for laces and insoles) when the package is returned from Spain (mainland and Balearic Islands), Portugal (mainland) and Europe (country of delivery). The cost of returns made from the Canary Islands, Ceuta, Melilla or another city outside Spain (mainland and Balearic Islands), Portugal (mainland) or the aforementioned European countries, as well as returns of insoles and laces, shall be borne by the customer, including all customs fees and other expenses. Fluchos shall not be held liable for any customs fees, nor shall it refund the return if the order fails to arrive at our facilities. In any case, please keep the item and original packaging in perfect condition.
To return an order, please enter the website www.fluchos.com/eu_en/ and go to the "My Account" section and then select "Returns", where you will see a list of all your orders. You will see a button next to the order number for returning goods. If it is an order sent to Ceuta, Melilla or the Canary Islands, you will receive an email to say that you may return the goods using the shipping method you wish. If you wish to return insoles or laces, our customer service department will contact you to manage the process. However, returns handled by Fluchos shall be processed via the SEUR website, in the case of orders delivered to Spain (mainland and Balearic Islands) and Portugal (mainland). When you click on the button, you will be redirected to the SEUR website where you will have to select whether you want a courier to pick up the order at your address or drop it off yourself at a collection point. After selecting the type of collection, please enter your details, the day and the time slot for pick-up. Once this process is complete, please print out the label and stick it on the package, which shall be the original packaging or, failing that, of a similar type. The package will now be ready for pick-up from your home or drop-off at a collection point. You will then receive an email from SEUR with the tracking code of your return. For returns of orders shipped to the European countries mentioned above, please inform our customer service department of the desired pick-up date and time. Once confirmed (please note: the date and time may differ from the ones provided, as it depends on the courier company), please stick the label on the package.
The goods shall not be considered the customer's property until the full retail price has been paid. Failure to pay in full shall entitle Fluchos to repossess the goods without prior notice and independently of any legal action, with the customer agreeing not to oppose this property rights clause. The costs incurred by the application of this clause, as well as the repair of any damage and/or wear-or-tear of the goods covered by this law, shall be entirely at the customer's expense.
APPLICABLE LAW AND JURISDICTION
These general terms and conditions shall be governed in accordance with Spanish law in all matters not expressly stated herein. The parties, expressly waiving any other jurisdiction which may correspond thereto, shall be subject, except in cases in which it is not legally permitted, to the jurisdiction and competence of the courts and tribunals of Logroño (Spain) for the resolution of any issues which may arise in relation thereto .
